General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to the use of the software purchased via the payment and sales service provider Digistore24.

2. Subject Matter of the Contract

The subject of the contract is the provision of paid software for digital use.
The specific scope of functions results from the respective product description on the sales page.

3. Conclusion of Contract

The contract for the purchase of the software is concluded between the customer and Digistore24.
The provider of the software is Alfonso D’Amore, VOUMEDIA.
Payment processing, invoicing, and any possible refunds are handled exclusively via Digistore24.

4. Rights of Use and License

The use of the software is subject to separate license terms, which form an integral part of these GTC.
The customer does not acquire ownership of the software, but rather a non-exclusive right of use within the scope described therein.

5. Term, Subscription and Cancellation

If the software is offered as part of a subscription, the following applies:

  • The license is limited to the respective billing period.
  • The subscription renews automatically unless it is cancelled in due time via Digistore24.
  • The terms governing duration and cancellation are those specified in the Digistore24 order process.

6. Updates and Support

Updates and support are provided exclusively within the scope of the respective booked plan.
There is no entitlement to future enhancements, new features, or permanent compatibility with third-party software (e.g. WordPress, themes, plugins).

7. Liability

The software is provided “as is”.
The provider is liable without limitation only in cases of intent and gross negligence.
In cases of slight negligence, the provider is liable only for breaches of essential contractual obligations and limited to the foreseeable damage.

Liability for data loss, loss of profit, or other consequential damages is excluded to the extent permitted by law.

8. Right of Withdrawal

As this concerns digital content, the right of withdrawal expires once use has commenced, provided that the customer has expressly agreed to this.
The handling of withdrawals is carried out via Digistore24.

9. Final Provisions

The law of the Federal Republic of Germany shall apply.
Should any provision of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
